Dans une lettre circulaire adress\u00e9e aux ministres et ministres d\u00e9l\u00e9gu\u00e9s, il a pr\u00e9cis\u00e9 qu\u2019aucun ministre ne peut, par note de service, d\u00e9cision ou arr\u00eat\u00e9, cr\u00e9er une direction centrale ou r\u00e9gionale ni nommer leurs responsables.<\/p>\n\n\n\n<p>Selon le SGG, plusieurs cas de cr\u00e9ations irr\u00e9guli\u00e8res de directions ont \u00e9t\u00e9 observ\u00e9s ces derniers mois. Il a soulign\u00e9 que de telles initiatives ne peuvent se faire que par d\u00e9cret pris en Conseil des ministres, conform\u00e9ment au d\u00e9cret n\u00b02011-178\/PR du 7 d\u00e9cembre 2011. Stanislas Baba a cit\u00e9 le texte pr\u00e9cisant que \u00ab les directeurs et leurs adjoints sont nomm\u00e9s par d\u00e9cret en Conseil des ministres sur proposition du ministre concern\u00e9 \u00bb, tandis que les directeurs des services ext\u00e9rieurs rel\u00e8vent d\u2019un d\u00e9cret du Pr\u00e9sident du Conseil.<\/p>\n\n\n\n<p>Le Secr\u00e9taire g\u00e9n\u00e9ral a \u00e9galement rappel\u00e9 que les ministres n\u2019ont le pouvoir de cr\u00e9er que des divisions ou sections internes \u00e0 leurs d\u00e9partements. En cas de vacance d\u2019un poste, ils doivent proposer un cadre pour nomination par d\u00e9cret. Toutefois, un int\u00e9rimaire peut \u00eatre d\u00e9sign\u00e9 provisoirement, pour trois mois au maximum, sous r\u00e9serve de l\u2019accord pr\u00e9alable du Pr\u00e9sident du Conseil. \u00ab Toute nomination ou cr\u00e9ation effectu\u00e9e en dehors du cadre l\u00e9gal est nulle et de nul effet \u00bb, a-t-il insist\u00e9.<\/p>\n\n\n\n<p>Ce rappel intervient dans un contexte de r\u00e9organisation administrative dans plusieurs minist\u00e8res. Par cette mise au point, Stanislas Bamouni Baba entend r\u00e9tablir la discipline administrative et garantir la l\u00e9galit\u00e9 dans la gestion des structures publiques.
